By using this site or downloading any of the Datashake software applications, you signify your irrevocable acceptance of these Terms of Use. You also agree to ensure that anyone who uses this software on your computer also abides by the Terms of Use. Datashake has the right to revise the Terms of Use at any time without providing notice to its users. Your continued use of the Datashake application shall be deemed as an irrevocable acceptance of those revisions. Datashake software is made available to you for your personal or internal business use in compliance with all applicable laws, rules and regulations.You may not distribute Datashake software or any services or software associated with or erived from it, modify, copy, license, or create derivative works from the Datashake application, unless you obtain Datashake''s written consent in advance.The Datashake application may communicate with our servers periodically to check for available updates to the software, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions or updates. By installing the Datashake application, you hereby agree to automatically request and receive updates from our servers.Information collected by Datashake may be stored and processed by us at any of our facilities. By using the Datashake application you consent to any such transfer of information outside of your country for such purposes.In regard to he Datashake application, you acknowledge that Datashake is the sole full owner of all related Intellectual Property Rights. "Intellectual Property Rights" are defined as all rights existing from time to time under patent law, copyright law, trade secret law, trademark law, unfair competition law, and any and all other proprietary rights, and any and all applications, renewals, extensions and restorations thereof, now or hereafter in force and effect worldwide. You agree not to (and agree not to allow third parties to) modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the Datashake application, or to extract significant portions of the Datashake application for use in other applications without our written consent.Datashake and any third party who makes its software or content available in conjunction with or through the Datashake application disclaim any responsibility for any harm resulting from your use (or use by your employees, agents or contractors) of the Datashake application and/or any third party software or content accessed in conjunction with it. Any Datashake application downloaded from this site is provided "as is" without any warranty of any kind. The entire risk as to the results and the performance of the software is assumed by the user, and in no event will Datashake be liable for any consequential, incidental or direct damages suffered in the course of using this software. Under no circumstances shall Datashake or any third party who makes its software or content available in conjunction with be liable to any user on account of that user''s use or misuse of the Datashake application. Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary and punitive damages whether such claim is based on warranty, contract, tort or otherwise. Such limitation shall apply notwithstanding a failure of essential purpose of any limited remedy and to the fullest extent permitted by law.
